Abstract
Penelitian ini membahas kedudukan dan penerapan pidana mati dalam hukum positif Indonesia pasca-berlakunya Kitab Undang-Undang Hukum Pidana (KUHP) Nomor 1 Tahun 2023. Permasalahan utama berakar pada perdebatan filosofis dan yuridis mengenai hukuman mati, yang berada di antara fungsi perlindungan masyarakat dari kejahatan berat dan jaminan hak hidup sebagai hak asasi manusia yang fundamental. KUHP 2023 memperkenalkan pengaturan baru berupa pidana mati bersyarat dengan masa percobaan sepuluh tahun, sehingga memunculkan implikasi terhadap asas kepastian hukum, keadilan, dan perlindungan hak terdakwa. Penelitian ini menggunakan metode yuridis-normatif dengan pendekatan peraturan perundang-undangan, konseptual, dan studi kasus. Hasil penelitian menunjukkan bahwa: (1) pidana mati masih dipertahankan sebagai pidana khusus dengan sifat ultimum remedium, (2) mekanisme percobaan dan penundaan eksekusi menimbulkan potensi permasalahan praktik, termasuk fenomena death row, dan (3) penerapan pidana mati membutuhkan kehati-hatian ekstra agar tetap sejalan dengan prinsip due process of law. Rekomendasi yang diajukan adalah penguatan jaminan peradilan yang adil, penegasan kriteria tindak pidana yang layak dikenai pidana mati, serta pengembangan alternatif pemidanaan yang lebih humanis. ABSTRACT This study examines the status and application of the death penalty in Indonesian positive law following the enactment of the Criminal Code (KUHP) Number 1 of 2023. The main issue lies in the ongoing philosophical and juridical debate regarding capital punishment, which is positioned between the function of protecting society from serious crimes and the guarantee of the right to life as a fundamental human right. The 2023 Criminal Code introduces a new provision in the form of a conditional death penalty with a ten-year probationary period, raising implications for legal certainty, justice, and the protection of defendants’ rights. This research employs a normative juridical method with statutory, conceptual, and case approaches. The findings show that: (1) the death penalty remains recognized as a special punishment with the nature of ultimum remedium, (2) the probation mechanism and execution postponement potentially create practical issues, including the phenomenon of death row, and (3) its application requires particular caution to ensure compliance with the principle of due process of law. The main recommendations are to strengthen fair trial guarantees, establish clear criteria for offenses subject to the death penalty, and consider the development of more humanistic alternatives to punishment.
