PRINSIP KEPASTIAN HUKUM KEWENANGAN NOTARIS ATAS PEMBUATAN AKTA RISALAH LELANG DITINJAU DARI UNDANGUNDANG NOMOR 30 TAHUN 2004 TENTANG PERUBAHAN ATAS UNDANG-UNDANG NOMOR 2 TAHUN 2014 TENTANG JABATAN NOTARIS ........... This research is motivated by the incompleteness of the norms contained in Article 15 paragraph 2 letter g of Law Number 2 of 2014 concerning the Position of Notaries regarding the requirements for a notary's authority in making auction minutes. This incompleteness of the norms creates legal uncertainty for auction minutes made by notaries who are not auction officials. This research aims firstly to determine and analyze the duties, responsibilities, and limits of a notary's authority in making auction minutes. Secondly to determine and analyze the legal consequences of auction minutes made by notaries. The research method used in this thesis uses doctrinal research/normative law research methods using statutory and conceptual approaches. Based on the results of this research, it can be concluded that firstly not all notaries have the authority to make Auction Minutes Deeds, only notaries who have been authorized and designated as Class II Auction Officials by the Minister of Finance are authorized to make Auction Minutes Deeds. Second, the auction minutes deed made by a notary who has not been appointed as a Class II Auction Official has no legal force and can be cancelled by law, and the auction minutes deed made by a notary who has been appointed as a Class II Auction Official has the same legal force as the auction minutes deed made by a state auction official.

Abstract

Penelitian ini dilatarbelakangi oleh ketidaklengkapan norma yang terdapat dalam pasal 15 ayat 2 huruf g Undang-undang Nomor 2 Tahun 2014 tentang Jabatan Notaris mengenai syarat-syarat kewenangan notaris dalam membuat akta risalah lelang. Ketidaklengkapan norma ini menimbulkan ketidakpastian hukum bagi akta risalah lelang yang dibuat oleh notaris yang bukan merupakan pejabat lelang. Penelitian ini bertujuan pertama untuk mengetahui dan menganalisis tugas, tanggung jawab, dan batas kewenangan notaris dalam pembuatan akta risalah lelang. Kedua untuk mengetahui dan menganalisis akibat hukum akta risalah lelang yang dibuat oleh notaris. Metode penelitian yang digunakan dalam skripsi ini menggunakan metode penelitian doctrinal research/hukum normatif dengan menggunakan pendekatan perundang-undangan dan konseptual. Berdasarkan hasil penelitian ini dapat disimpulkan bahwa pertama tidak semua notaris mempunyai kewenangan untuk membuat Akta Risalah Lelang, hanya notaris yang telah disahkan dan ditetapkan sebagai Pejabat Lelang kelas II oleh menteri keuangan saja yang berwenang untuk membuat Akta Risalah Lelang. Kedua bahwa akta risalah lelang yang dibuat oleh notaris yang belum diangkat sebagai Pejabat Lelang Kelas II tidak memiliki kekuatan hukum dan dapat batal demi hukum akta risalah lelangnya, dan akta risalah lelang yang dibuat oleh notaris yang telah di angkat menjadi Pejabat Lelang Kelas II memiliki kekuatan hukum yang sama dengan akta risalah lelang yang dibuat oleh pejabat lelang negara.
