Abstract

ANALISIS PENERAPAN UNDANG-UNDANG NOMOR 22 TAHUN 2022 TENTANG PEMASYARAKATAN TERHADAP PEMBINAAN NARAPIDANA DI LEMBAGA PEMASYARAKATAN ANALYSIS OF THE APPLICATION OF LAW NUMBER 22 OF 2022 CONCERNING CORRECTIONS TO THE DEVELOPMENT OF PRISONERS IN CORRECTIONAL INSTITUTIONS Alin Ramadhani., Ide Prima Hadiyanto, Irwan Yulianto. [email protected] Ilmu Hukum, Fakultas Hukum, Universitas Abdurachman Saleh Situbondo ABSTRAK Pemasyarakatan merupakan kegiatan untuk melakukan pembinaan kepada Warga Binaan Pemasyarakatan berdasarkan sistem, kelembagaan, dan cara pembinaan dimana pemasyarakatan ini merupakan bagian paling akhir dari suatu sistem pemidanaan dalam tata peradilan pidana. Dalam penelitian ini pokok permasalahan yang diangkat adalah mengenai konsep pembinaan narapidana dalam sistem pemasyarakatan dan analisis terkait penerapan Undang-Undang Nomor 22 Tahun 2022 terhadap pembinaan narapidana di Lembaga Pemasyarakatan dikaitkan dengan tujuan pemidanaan. Tujuan dari penelitian ini adalah untuk mengetahui mengenai pokok permasalahan yang telah disebutkan sebelumnya. Manfaat dari penelitian ini yaitu sebagai referensi yang dapat dijadikan bahan kajian dalam bidang ilmu hukum serta dapat memberikann informasi mengenai pembinaan yang dilakukan di dalam sebuah Lembaga Pemasyarakatan. Penelitian ini menggunakan metode penelitian yuridis normatif. Metode pengolahan data yang digunakan adalah metode deskriptif kualitatif, yakni dengan mengkaji lebih dalam melalui literatur yang telah dikumpulkan, baik buku, artikel, jurnal hukum, e-book, putusan hakim, maupun dari hasil penelitian terdahulu. Berdasarkan hasil penelitian dapat disimpulkan, Pelaksanaan pembinaan narapidana dalam sebuah Lembaga Pemasyarakatan tidak ada aturan resmi dari Pemerintah mengenai spesifikasi kegiatan yang harus dilaksanakan, jadi setiap Lembaga Pemasyarakatan cenderung melaksanakan kegiatan yang berbeda-beda. Selain itu, aturan yang berlaku pun dinilai sudah kuno dan harus ada perubahan terhadap aturan tersebut. Kata kunci: petunjuk penulisan; jurnal pertanian; template artikel ABSTRACT Correctional correction is an activity to provide training to correctional inmates based on systems, institutions and training methods where correctional is the final part of a punishment system in the criminal criminal system. In this research, the main issues raised are the concept of coaching in the correctional system and analysis related to the application of Law Number 22 of 2022 to coaching in correctional institutions related to the purpose of punishment. The aim of this research is to find out about the main problems mentioned previously. The benefit of this research is that it is a reference that can be used as study material in the field of legal science and can provide information regarding training carried out in a correctional institution. This research uses normative juridical research methods. The data processing method used is a qualitative descriptive method, namely by examining in more depth through the literature that has been collected, including books, articles, legal journals, e-books, judge's decisions, as well as the results of previous research. Based on the results of the research, it can be concluded that in the implementation of prisoner development in a correctional institution there are no official regulations from the government regarding the specifications of the activities that must be carried out, so each correctional institution tends to carry out different activities. Apart from that, the applicable regulations are considered to be outdated and there must be changes to these regulations. Keywords: Correctional Institutions, Prisoner Development, Punishment
