Abstract
Kebebasan berpendapat di Indonesia dijelaskan dalamUUD 1945 sertaUU No. 9 Th1998, serta diakui oleh Deklarasi Universal Hak Asasi Manusia, tetapi sering mengalami pembatasan demi keamanan, stabilitas, dan norma sosial. Teknologi informasi memperluas ruang untuk berpendapat namun juga menghadapi risiko seperti pencemaran nama baik dan ujaran kebencian, yang dikenakan sanksi pidana dan administratif. Dalam hukum Islam, kebebasan berpendapat diakui sebagai hak dari Allah, namun harus sesuai dengan nilai moral, dengan pelanggaran seperti fitnah dianggap haram dan dapat merusak reputasi serta demokrasi. Harmonisasi antara prinsip hukum positif dan nilai-nilai agama diperlukan dalam menyelaraskan hak individu dan masyarakat, dengan perlindungan terhadap hak ini diperkuat oleh Pasal 28 dan Pasal 28E ayat 3 UUD 1945 serta UUITE. Indonesian freedom of speechis governed the 1945 Constitution and Law No. 9 of 1998, andacknowledgedbytheUnitedNationsDeclarationonHumanRights,butisoftensubject to restrictions for the sake of security, stability and social norms. Information technology expands the space for speech but also faces risks such as defamation and hate speech, which are subjectto criminaland administrative sanctions. In Islamiclaw, Speech freedom is acknowledged as a rightfrom Allah, but must be in accordance with moral values, with violations such as slander considered haram and can damage reputation and democracy. Harmonization between positive legal principles and religious values is necessary maintaining a harmony between personal liberties and societal interests, the protection of these rights is strengthened under the 1945 Constitution's Article 28 and Article 28E, paragraph 3, and the ITE Law.
